I think the litmus test in this case on to whether it was hacking or not, is the fact that you could be sent an unsecured URL to gain access to the content. To me, that shows it is wide open to the public</description>

Again I don't think there was any other choice in this circumstance...  The FBI is a moot point, the dude didn't get in trouble--additionally I would have gone to the FBI first to make sure it was legal.  If it turns out that there was illegality involved going to the Kennedy peeps would have made it look like they were trying to hide something illegal.
